Why Doesn’t a Standard NDA Protect a Design in China?

A standard, US-style NDA usually doesn’t hold up against a Chinese factory, and it’s not because the factory intends to steal anything. It’s structural. Enforceability is the first problem: a foreign-law NDA generally needs Chinese-language proceedings and PRC law behind it to be enforced in a Chinese court, and collecting on a foreign judgment against Chinese assets is impractical for what a typical CNC order is worth.
